Call Update: Impact of NJDEP Ruling for PennEast

During tomorrow's conference call, in addition to a detailed discussion about the impact of the recent D.C. Circuit ruling on pending New York State pipeline projects, we also plan to cover today's ruling from the New Jersey Department of Environmental Protection (NJDEP) to "administratively close" the PennEast Pipeline Project's Freshwater Wetland's permit application.

As referenced last month in a LawIQ customer note before the NJDEP ruling, we "anticipate that PennEast may need to wait for a FERC Certificate, then gain access to the remainder of its right-of-way through the courts in order to complete the required surveys before obtaining the NJDEP application."
