Conference Call: Impact of DC Circuit Ruling on Pending NY Projects

Last week, the DC Circuit denied Millennium Pipeline's appeal concerning the New York Department of Environmental Conservation's (NYSDEC) failure to issue a Section 401 Water Quality Certificate (WQC) within one year after Millennium submitted its application.
The decision means that if a state fails to act within a reasonable time period (i.e., one year) an applicant pipeline may submit a request to FERC to allow construction since the state has waived its right to issue a WQC. In effect, the Court has shifted WQC authority to the FERC after one year of inaction at the state level.
